Q: Who is deemed a "homeowner"?
A: According to the 2024 Implementing Rules and Regulations of Republic Act 9904 (Magna Carta for Homeowners and Homeowners Associations), a “homeowner” is an owner or purchaser of a lot or house and lot, in a subdivision or village.
Q: Is membership in the Hillsborough Pointe HOA mandatory?
A: YES, as provided in the Declaration of Restrictions given to each homeowner during lot purchase, specifically Article V – Association and Assessments, Section 1.1.2 which says that “Every Home and Lot Owner in the Village shall be, and automatically is, a member of the Association. Membership shall be appurtenant to, and may not be separated from ownership or possession of the lot”. Likewise, as annotated in the Memorandum of Encumbrances of each Transfer Certificate of Title specifically Article I which says “The purchaser/s, his/their heirs, successors or assigns binds himself/themselves to become a member of Hillsborough Pointe Homeowners Association (The ‘Association’)”…
Q: What is the basic right of a homeowner?
A: Every homeowner has the “right to enjoy the basic community services and facilities”, provided that he pays the necessary fees and other pertinent charges for such services.
Q: What are the basic community services and facilities that a homeowner must enjoy?
A: “Basic community services and facilities” refer to services and facilities that redound to the benefit of all homeowners and from which, by reason of practicality, no homeowner may be excluded, such as:
(a) security
(b) street and vicinity lights
(c) maintenance
(d) repairs
(e) cleaning of streets
(f) garbage collection and disposal
(g) other similar services and facilities
Q: What are "common areas"?
A: “Common areas” refer to property owned or otherwise maintained, repaired, or administered, in whole or in part, by the homeowners association, LGU, or subdivision owner or developer, as the case may be, including:
(a) clubhouses and swimming pools
(b) roads and sidewalks
(c) parks
(d) playgrounds
(e) open spaces, as provided in PD 1216
Q: When does the HOA office open?
A: The HOA Office is open from 8:00 AM to 12:00 NN and 1:00 PM to 5:00 PM, Monday to Saturday. The office is closed on Sundays and during regular holidays.
Q: Why do we need to pay monthly dues?
A: Monthly dues are collected to cover the operational expenses of the village such as security, garbage collection, street lighting, maintenance of common areas, personnel salary etc. These contributions ensure that the community remains clean, safe, and well-managed for all residents.
Q: What are the modes of payment for HOA dues and other payables?
A: You may settle your HOA dues and other payables such as rentals, car stickers, constructions fee, etc. through cash, check, or bank transfer. Kindly submit your proof of payment to the HOA office to ensure proper validation and recording.
Q: Why are visitors and delivery riders required to deposit their ID at the gate?
A: To regulate entry as part of the village protocol
